Booking through Andalucian Sky
Terms and Conditions
ANDALUCIAN SKY is a company specialising in holiday rental properties particularly in rural areas, conducting its business through its website across all online platforms.
Andalucian Sky acts as an intermediary between property owners and holidaymakers (clients) wishing to stay in Andalucía. Clients are offered a bespoke, holiday booking experience—being able to choose from a range of excellent holiday accommodation, managed by owners who are committed to high quality tourism. Andalucian Sky visits each property before selection for its website to ensure the property meets the appropriate criteria.
ANDALUCIAN SKY acts solely as an intermediary agent between the owner of the villa booked for the holiday (the Owner) and you, the client who makes the booking. On confirmation of a booking, you will enter into a direct (legally binding) contractual relationship with the Owner. Andalucian Sky is not a party to the contractual relationship you have with the Owner. By confirming a booking with Andalucian Sky, you, agree to accept these terms and conditions.
1.1 A booking is confirmed once you have paid the deposit of 25% of the villa price to Andalucian Sky. This deposit is non-refundable and is held by us on behalf of the Owner as a guarantee against cancellation—see ‘Cancellations‘ at point 2 below.
1.2 The balance of the villa price is to be paid by you 56 days (8 weeks) before the start of the booking. If the balance payment is not made on time, the booking may be cancelled by Andalucian Sky—see ‘Cancellations‘ at point 2 below.
1.3 The price you pay is as on the Andalucian Sky website on the date the booking is confirmed.
1.4 The price you pay will always be in Euros and includes IVA.
1.5 If you wish to book a villa less than 8 weeks before your arrival, the full balance is to be paid on booking.
1.6 Please check your holiday confirmation and all other documents you receive from us as soon as you receive it. If there appear to be any discrepancies you must notify us as soon as possible. It may not be possible to rectify errors if not brought to our attention within a reasonable time.
2.1 In the event of you cancelling your booking, the following refunds will apply:
up to 56 days before the holiday start date, 75% of the amount due on the holiday booking
43-55 days before the holiday start date, 60% of the amount due on the holiday booking
29-42 days before the holiday start date, 40% of the amount due on the holiday booking
22-28 days before the holiday start date, 20% of the amount due on the holiday booking
21 days before the holiday start date, there will be no refund of the amount due on the holiday booking
3.1 We will always visit new properties and undertake further visits/inspections to the property whenever deemed necessary.
3.2 We endeavour to make accurate representations of the properties on our websites and in all sales literature. It is the responsibility of the Owner to ensure that their property is accurately described on the website and to inform us of any changes to the villa subsequent to the property being visited. Some descriptions may be seen as subjective, and although we visit each property, Andalucian Sky is not responsible for any changes by the Owner since our last visit.
3.3 The cost of any claim for compensation, or the cost of moving you, in the event that the property is not as described and for which a solution cannot be provided, will be the responsibility of the Owner. If your complaint is well founded, we will do our best to move you to alternative accommodation if requested.
4.1 Unless otherwise stated, villas will be ready for you to arrive at 17:00 (5 pm). Departure time is 10:00 (10 am) to allow the property to be made ready for the next guests.
4.2 The villas are reserved for the number of guests stated in your booking. Extra persons are not allowed to stay in the property and may be asked to leave or be subject to a supplementary charge.
4.3 Some villas may be booked for special events like wedding celebrations. Such events will need to be agreed with us in writing in advance and appropriate payments made (if applicable).
4.4 Most villas do not accept pets unless stated in a particular property’s ‘Villa Notes’ on the website. If you want to bring your pet please discuss with us before booking. If you are allergic to animals please let us know before booking—we can discuss with you as to whether pets have previously stayed at the villa.
4.5 Swimming pools—it is your responsibility to use the swimming pool at the villa in a safe way. This means supervising children and non-swimmers at all times and taking due care to keep you and your party safe.
4.6 Internet—while internet coverage is generally good in Andalucia, we cannot guarantee the internet speed and reliability at each villa. If internet facilities are particularly important to you please speak to us before booking.
4.7 Country wildlife and noise—most of our villas are in peaceful, rural areas, but there may be the possibility of country noises eg animal sounds, farm machinery, fiesta fireworks/music which is outside of our control. Similarly, wildlife like insects or wild birds/animals may make their presence known. If these aspects of rural life may be a problem to you or any of your party, then it might be better not to book a rural property.
Please notify us if there is any damage to the property. In case of damage or loss caused to the property by you, which cannot be covered by reasonable replacement costs, Andalucian Sky, as the intermediary, reserve the right to use the security deposit received from you to address such damage.
6.1 If you have a complaint about your villa during your holiday, please contact Andalucian Sky immediately so that we (a) may log the complaint at the time and (b) have the chance to discuss with the Owner who then has an opportunity to put matters right.
6.2 Complaints notified to us after leaving cannot be dealt with because the Owner will not have had the opportunity to rectify the problem.
Subject to being given advance notice, you agree to allow reasonable access to the Owner/their staff for any necessary villa maintenance.
In the unlikely event that the Owner cancels the booking, Andalucian Sky will make every endeavour to find you alternative accommodation of equal value. If you choose not to accept this then you will be entitled to full refund of the cost of your accommodation. Andalucian Sky’s liability is limited to the monies paid for the accommodation only and we highly recommend that you take out travel insurance to cover any or all associated holiday costs.
Andalucian Sky does not provide insurance for you and is not responsible for any loss or damage to you or your party while staying at the villa. This includes accidents of a personal injury nature and damage to your or the Owner’s property. Andalucian Sky are not liable for accidents during your stay.
We strongly advise that you take out holiday travel and personal insurance to cover you and your party before your arrival.
Andalucian Sky cannot accept responsibility for matters outside its control which may cause delays, cancellations, loss or damage to you or your party. Such matters by way of example are, but not limited to: bad weather, war, civil strife, industrial action, fire, flood, epidemics, government or public authority action.
Andalucian Sky will maintain a database of clients for the purpose of organising their holiday. By accepting these terms and conditions, you consent to the holding and processing of personal information by Andalucian Sky, for purposes relating to booking your holiday, tailoring your holiday to your needs and payment of bookings only. These terms and conditions shall be governed by Spanish law and the parties submit to the jurisdiction of the Spanish courts.
